Ordering products, in any format, following use of this Website is subject to the following terms and conditions. Please read the following terms and conditions carefully and be sure you understand them. The placing of an order constitutes acceptance of the terms and conditions outlined in it (the "Agreement"). From time to time the terms of this Website may change, so it is important that you review these terms every time you place an order. We are and are referred to as:- "ACTIVE Learning", "Active" and "Active Educational". Ownership; All products & goods supplied by ACTIVE Learning remain the property of ACTIVE Learning until full payment has made. Themed Topic Packs; Please note; Occasionally, due to the nature of these multi-itemed packs and unforeseen stock circumstances/supply delays, we may need to replace an advertised item with a suitable alternative of equivalent quality & value. This is helps prevent unacceptable delays in getting your goods to you. We reserve the right to do this. Dispatch Times; We aim to dispatch all orders within14 days of receipt of your order, however please allow 28 days as occassionally our suppliers experience stock or delivery problems. UK Orders; (Schools, Nurseries & Local Authorities) Orders made by schools, nurseries or local authorities do not need to pay at the time of ordering. An invoice for payment will be sent with the product. Individual Teachers placing personal orders need not pay at the time of ordering as long as the delivery address is a recognised school or local authority address - an invoice for payment will be sent with the product. UK Orders; (Personal Retail, General Public, etc.) Where delivery is to anywhere other than School or Local Authority addresses (in particular to residential addresses), payment must be made with the order and all cheques must be cleared prior to dispatch of goods. Teachers requesting delivery to home/residential addresses fall into this catagory. However, this condition may be waived for existing customers - who should phone to confirm. UK Delivery Charges; Carriage and insurance costs for "Themed Topic Packs" to addresses in the UK is as follows:- £7.50 per "School Pack", £5.50 per "Class Pack" and £4.50 per "Teacher Pack" up tp a maximum of £15.00 (any mix of packs). All other products, storybook-animals, topic extras and resources are charged at a flat rate of £1.75 per item (free with Topic Packs) up to a maximum of £5.00. Postage charges attract VAT. Overseas Delivery Charges (to Non-UK Addresses). Delivery Charges to addresses outwith the UK will incur a delivery & insurance charge. Once your order has been received we will price delivery costs and will contact you by e-mail or fax to inform you of the cost. Should you accept this delivery cost, confirmation of acceptance must be sent by fax or e-mail and only then shall your goods be dispatched. Obviously, according to the weight of your order/goods and where you want them delivered will determine the cost. We shall endeavour to source a fair price for delivery or follow your instructions. Orders with a value over £3,500 (GB) will have delivery free. Cancellation; You may cancel your order by writing to us by post or e-mail within 7 days of receipt of the goods by you. You must then return the goods to us within 14 days at your expense in an undamaged, unused and unopened condition. If payment has been made we will refund the cost of your order subject to deduction of any delivery charge incurred by us. This does not affect your statutory rights. Damaged or Defective Items; Damaged or defective items must be reported within 3 working days of reciept. These will be replaced at our expense, failing which a full refund will be made. Please report defects/damages by fax., e-mail or telephone during business hours (between 9.00 am and 5.00 pm on Monday to Friday). Calls left on our answering machine will be logged and your call returned within 24 hours. Normal national telephone rates apply. Privacy Policy; We do not retain customers' details for any purpose other than the fulfillment of orders and the distribution of our own products and product information. In particular, we will not disclose customers' details to any third parties, except for the sole purpose of completing an order. All information received via customer orders is collected lawfully. Complaints; While we aim to avoid complaints by providing a quality service, we recognise that an essential part of any quality service is the provision of an effective complaints procedure. Any complaints should be forwarded in writing (by e-mail or fax) marked as a complaint and for the attention of Callum Cameron. Complaints should be made within seven days of the complaint first arising. We will endeavour to respond to your complaint within three working days, with the intention of resolving all complaints fairly, confidentially, effectively and speedily. Law; In the event of a dispute or conflict arising, Scots Law shall apply. IF YOU DO NOT AGREE TO THE TERMS STATED ABOVE, PLEASE DO NOT SUBMIT AN ORDER TO ACTIVE Learning. SHOULD CLARIFICATION BE REQUIRED ON ANY POINT, PLEASE FAX, E-MAIL OR PHONE. OTHER TERMS & CONDITIONS......................... You may download one copy of the material in temporary storage on one computer for your PERSONAL INFORMATION AND NON-COMMERCIAL USE ONLY, provided you do not delete or change any copyright, trademark, or other proprietary notices. Except as expressly provided above, nothing contained herein shall be construed as conferring any license or right under any copyright or any other intellectual property right. If you are an owner of intellectual property who believes their intellectual property has been improperly posted or distributed via this Website, please notify ACTIVE Learning immediately at the address above. Your Communications to "ACTIVE" - we would like to hear from you. However, in your communications with us, please keep in mind that, although we welcome suggestions for topic packs and products, ACTIVE Learning is under no obligation to act on, or consider, any creative ideas or suggestions relating to products. Your Ideas Count!......... Please do send suggestions and ideas to us. We aim to improve by offering what you want & need - not what we "think" you want! Any creative or original ideas and materials for educational resources/accessories, toys, games, or other suitable products are welcome. Should your intention be to form a "commercial partnership" with ACTIVE Learning, you must make this clear in writing at the outset of correspondence and we will respect this. Otherwise, any creative suggestions, ideas, notes, drawings, concepts, or other information, any communication or material you transmit to our website by electronic mail or otherwise, including any personal data, questions or answers, comments, suggestions, or the like becomes the property of ACTIVE Learning and will be treated as nonconfidential, nonproprietary and may be used by us without compensation.
